Course Introduction
Large-scale infrastructure, construction, transportation, energy, water, and public-private partnership projects are highly susceptible to disputes arising from scope changes, delays, cost overruns, unforeseen site conditions, contractual ambiguities, and stakeholder conflicts. Traditional dispute resolution methods often result in lengthy proceedings, escalating costs, project disruptions, and damaged relationships among contracting parties. Dispute boards have emerged as an effective mechanism for preventing, managing, and resolving disputes during project implementation. This course provides participants with comprehensive knowledge and practical skills for establishing, managing, and utilizing dispute boards to achieve timely and effective dispute resolution.
Modern infrastructure projects increasingly incorporate dispute avoidance and dispute board mechanisms as critical governance tools within project contracts. These mechanisms facilitate early intervention, impartial expert guidance, continuous project oversight, and prompt resolution of emerging disagreements before they escalate into formal disputes. Participants will gain a thorough understanding of dispute board structures, operational procedures, contractual frameworks, and decision-making processes that support successful project delivery and risk mitigation.
The course explores the full lifecycle of infrastructure dispute management, from contract formation and claims identification to dispute board proceedings, recommendations, determinations, and enforcement strategies. Participants will learn how dispute boards operate under international construction contracts, public infrastructure projects, development-funded initiatives, and complex engineering programs. Emphasis is placed on practical implementation strategies that improve project performance while reducing legal exposure.
Claims review and management form a significant component of dispute prevention and resolution efforts. Participants will develop expertise in evaluating claims related to delays, variations, disruptions, acceleration, force majeure events, payment disputes, and contractual entitlements. The training also examines emerging issues influencing infrastructure dispute resolution, including digital project records, Building Information Modeling (BIM), virtual hearings, environmental and social compliance disputes, climate resilience considerations, data-driven claims management, and the increasing use of technology in dispute board proceedings.
