Introduction
Regulatory capture and unmanaged conflicts of interest undermine the credibility, effectiveness, and legitimacy of regulatory institutions. This course introduces participants to the structural, behavioral, and institutional drivers of capture, and explains why preventing undue influence is essential for protecting public interest and ensuring fair regulatory outcomes.
Regulators operate in close proximity to powerful stakeholders, technical experts, and political actors, creating inherent risks of bias, dependency, and influence. This course examines how capture can emerge subtly over time through information asymmetry, revolving doors, and informal relationships rather than overt corruption.
Participants will explore how conflicts of interest arise at individual, organizational, and systemic levels, affecting rulemaking, supervision, enforcement, and licensing decisions. The course emphasizes the importance of transparency, ethical judgment, and institutional safeguards in managing these risks effectively.
The program integrates international standards, comparative case studies, and real regulatory failures to illustrate how capture weakens competition, distorts markets, and erodes public trust. Participants analyze practical examples to understand warning signs, vulnerabilities, and prevention strategies.
Emerging challenges such as digital platform regulation, public-private data sharing, expert reliance, and cross-border regulation introduce new forms of capture risk. The course addresses how governance and integrity frameworks must evolve to address these complex and less visible influence channels.
By the end of the course, participants will be equipped to design and implement robust institutional frameworks that prevent regulatory capture, manage conflicts of interest, strengthen accountability, and reinforce independent, ethical, and resilient regulatory systems.
