Introduction
International investment has become a central pillar of global economic development, shaping cross-border capital flows, infrastructure financing, and strategic partnerships between states and private investors. This course provides a comprehensive and practice-oriented examination of the legal regimes governing foreign direct investment, bilateral and multilateral treaties, and investor–state dispute settlement mechanisms in a rapidly evolving regulatory environment.

Participants will explore the substantive standards of investor protection embedded in international investment agreements, including fair and equitable treatment, full protection and security, national treatment, and most-favored-nation clauses. The course critically analyzes how these protections are interpreted by arbitral tribunals and how they interact with domestic legal systems and sovereign regulatory powers.

The program further examines the architecture of bilateral investment treaties (BITs), regional trade agreements with investment chapters, and multilateral frameworks that influence investor rights and state obligations. Emphasis is placed on treaty drafting techniques, risk allocation, stabilization clauses, and emerging reform trends aimed at balancing investment promotion with sustainable development objectives.

Through case studies and comparative jurisprudence, participants will evaluate landmark investor–state disputes and assess the evolving standards applied by tribunals constituted under rules such as ICSID and UNCITRAL. The training bridges theory and practice by analyzing procedural strategies, jurisdictional objections, damages assessment, and enforcement of arbitral awards.

The course also addresses contemporary policy debates, including climate change regulation, human rights obligations, corporate social responsibility, and the reform of investor–state dispute settlement systems. Participants will gain insight into how governments design investment policies that attract capital while safeguarding public interest and regulatory autonomy.

By integrating doctrinal analysis with practical drafting and negotiation exercises, this training equips legal practitioners, policymakers, and corporate advisors with advanced knowledge and applied skills necessary to manage investment risks, negotiate treaties, and protect investor interests in complex international transactions.
