Course Introduction

The Construction Claims, Delay and Forensic Schedule Management Course provides an advanced, practical framework for identifying, analyzing, substantiating, evaluating, and resolving construction claims arising from delays, disruption, variations, acceleration, and other project events. Construction disputes frequently involve complex contractual obligations, evolving design requirements, incomplete records, changing site conditions, resource constraints, and competing interpretations of responsibility. This course equips participants with the technical, contractual, commercial, and analytical skills needed to investigate project events systematically, establish defensible positions, and support fair, evidence-based decisions throughout the construction project lifecycle.

Delay claims can have substantial financial and operational consequences for project owners, contractors, subcontractors, consultants, and suppliers. Establishing entitlement requires more than identifying a late activity or comparing planned and actual completion dates. Participants examine the relationship between contractual milestones, approved baselines, critical path activities, contemporaneous progress records, delay notifications, and the obligations of the parties. The programme explores how to distinguish excusable, compensable, and non-excusable delays where applicable under the governing contract, while considering concurrency, mitigation, extension-of-time entitlement, and the effect of employer-caused and contractor-caused events.

A central component of the course is forensic schedule analysis, which involves reconstructing project performance and evaluating the time-related effects of events using reliable planning data and documented evidence. Participants examine recognized analytical approaches, including impacted as-planned analysis, time impact analysis, as-planned versus as-built comparisons, windows analysis, and retrospective longest-path analysis. The course addresses the appropriate selection of methods based on the contract, available records, project circumstances, analytical purpose, and applicable professional guidance. Emphasis is placed on schedule logic, baseline integrity, critical path movement, data quality, analytical assumptions, and transparent explanation of findings.

The programme also develops participants’ ability to assess the commercial implications of delay and disruption. Topics include prolongation costs, extended site overheads, disruption-related productivity losses, acceleration costs, standby resources, additional supervision, equipment inefficiency, and the treatment of costs associated with variations and changed working conditions. Participants learn how to organize cost evidence, test supporting records, assess causation, distinguish direct and indirect effects, and avoid double counting or unsupported assumptions. The course also considers the relationship between contractual entitlement, causation, quantum, mitigation, and the documentation required to substantiate or challenge a claim.

Effective claims management depends on contemporaneous records, disciplined contract administration, and clear communication between project stakeholders. Participants examine notices, instructions, correspondence, daily reports, meeting minutes, site diaries, resource records, procurement logs, progress photographs, inspection records, and schedule updates as sources of evidence. The course explores how claims registers, event chronologies, responsibility matrices, document protocols, and structured review procedures can improve traceability and audit readiness. Emerging practices involving digital project records, common data environments, schedule analytics, and AI-assisted document review are also considered, with attention to confidentiality, data integrity, human verification, and defensible analytical conclusions.

By the end of the programme, participants will be better equipped to prevent avoidable disputes, evaluate delay allegations, prepare or review extension-of-time submissions, analyze disruption evidence, and support informed commercial negotiations. Through practical case studies, schedule exercises, event mapping, record evaluation, and claim assessment scenarios, the course connects contractual principles with the realities of project execution. It is designed to improve the quality of claims preparation, strengthen forensic schedule analysis, promote proportionate dispute resolution, and support commercially sound outcomes while respecting the governing contract, applicable law, and relevant professional standards.
