Course Introduction

Bilateral Investment Treaties (BITs) play a vital role in promoting foreign direct investment (FDI), protecting investors, and strengthening economic cooperation between countries. Governments increasingly rely on BITs to create a stable and predictable investment climate while ensuring that national interests and public policy objectives are safeguarded. The Bilateral Investment Treaty (BIT) Negotiation and Review Course equips participants with the practical skills required to negotiate, interpret, and review treaty provisions in line with international investment law and national development priorities.

BITs influence regulatory stability, investor protection, dispute settlement mechanisms, and economic growth prospects. As global investment flows continue to evolve, policymakers and legal experts must understand how to structure treaty provisions that balance investor confidence with sovereign policy flexibility. This course provides practical knowledge on treaty drafting principles, legal interpretation, risk allocation, and dispute mitigation strategies that enhance effectiveness of international investment frameworks.

Participants will examine key provisions in BITs including fair and equitable treatment, expropriation standards, national treatment obligations, dispute resolution clauses, and investor protections. The course explores how treaty language affects regulatory authority, fiscal policy, environmental safeguards, and social policy commitments while ensuring compliance with international legal obligations and development objectives.

The course also addresses emerging issues such as sustainable investment treaty provisions, climate-related obligations, human rights considerations, digital economy investments, and policy reforms aimed at improving balance between investor protection and state regulatory space. Participants will gain insights into evolving global treaty practices and reform initiatives influencing BIT negotiation strategies.

Through case studies and practical negotiation simulations, participants will develop competencies in treaty review, legal risk assessment, policy alignment, and negotiation strategy development. Emphasis is placed on strengthening capacity to analyze treaty provisions, identify legal gaps, propose amendments, and negotiate mutually beneficial agreements that support economic development and international cooperation.

By the end of the training, participants will have gained practical skills necessary to negotiate modern BITs, assess treaty risks, interpret international investment law provisions, and support government or institutional negotiation teams in achieving balanced, transparent, and development-oriented treaty outcomes.
