Course Introduction

Agile Contracting and Procurement Course provides a practical framework for managing procurement and contractual relationships in environments where requirements, priorities, solutions, and delivery conditions may evolve throughout the project lifecycle. The programme helps procurement professionals, project managers, contract specialists, and suppliers understand how commercial practices can support Agile delivery without sacrificing governance, accountability, transparency, or value for money.

The course examines the limitations of rigid contracting approaches when projects involve uncertainty, innovation, evolving requirements, iterative development, and frequent customer feedback. Participants learn how to structure procurement strategies, statements of work, commercial terms, supplier relationships, pricing mechanisms, acceptance criteria, and governance arrangements that accommodate change while maintaining appropriate commercial and organizational controls.

Participants will explore Agile procurement planning, supplier selection, contract models, collaborative negotiation, incremental funding, outcome-based requirements, flexible scope management, iterative acceptance, performance measurement, risk allocation, intellectual property, confidentiality, data protection, and dispute management. Practical approaches are provided for balancing customer and supplier interests while establishing relationships based on transparency, trust, shared objectives, and measurable outcomes.

The programme also focuses on managing suppliers throughout iterative delivery. Participants learn how to collaborate with vendors during product discovery, Sprint-based delivery, reviews, testing, acceptance, release planning, and continuous improvement. The course addresses common commercial challenges such as changing requirements, unclear specifications, fixed-price constraints, supplier dependency, competing incentives, contract variations, delayed approvals, and disagreements over acceptance or payment.

Modern procurement is increasingly influenced by digital transformation, artificial intelligence, cloud services, cybersecurity, distributed delivery teams, platform ecosystems, sustainability expectations, and complex regulatory requirements. The course therefore examines emerging commercial issues and how procurement and contract management practices must evolve to address technology risks, data ownership, responsible AI, supplier resilience, cybersecurity obligations, and rapidly changing business environments.

By completing the course, participants will be able to develop more adaptive procurement strategies, evaluate appropriate Agile contracting models, negotiate commercially sustainable agreements, manage supplier relationships, and establish governance mechanisms that support iterative delivery. The programme enables participants to align commercial arrangements with Agile principles while protecting organizational interests, improving supplier performance, reducing contractual friction, and maximizing delivered business value.

Comprehensive Course Outline

Module 1: Foundations of Agile Contracting and Procurement

  • Understanding Agile principles and how they influence procurement strategy, commercial relationships, requirements, supplier engagement, governance, and contractual decision-making.

  • Examining the limitations of traditional procurement models when projects involve uncertainty, innovation, evolving requirements, iterative development, and complex stakeholder needs.

  • Exploring the relationship between Agile delivery, procurement objectives, value for money, commercial accountability, transparency, risk management, and customer outcomes.

  • Identifying organizational, legal, commercial, and cultural factors that influence successful adoption of Agile procurement and contracting practices.

Module 2: Agile Procurement Strategy and Planning

  • Developing procurement strategies that align sourcing decisions with Agile delivery models, project objectives, business value, risk appetite, timelines, and organizational policies.

  • Determining which requirements should be defined upfront and which can evolve through iterative discovery, supplier collaboration, prototyping, and customer feedback.

  • Designing procurement plans that address market analysis, supplier availability, sourcing routes, evaluation criteria, commercial risks, dependencies, and delivery constraints.

  • Establishing appropriate procurement governance that maintains transparency, competition, compliance, accountability, and flexibility throughout the sourcing and delivery lifecycle.

Module 3: Agile Requirements, Scope, and Statements of Work

  • Developing outcome-focused requirements that communicate business objectives while allowing suppliers sufficient flexibility to determine effective technical and delivery solutions.

  • Designing statements of work that support incremental delivery, evolving priorities, iterative acceptance, measurable outcomes, and transparent commercial expectations.

  • Establishing acceptance criteria that are clear enough to support commercial accountability while remaining adaptable to legitimate learning and requirement evolution.

  • Managing the relationship between product backlogs, user stories, specifications, contractual scope, deliverables, milestones, and evolving project priorities.

Module 4: Agile Contract Models and Pricing Structures

  • Comparing fixed-price, time-and-materials, capped time-and-materials, target-cost, outcome-based, incremental, and other commercial structures for Agile project environments.

  • Selecting contract models according to uncertainty, complexity, supplier capability, risk allocation, customer involvement, delivery frequency, and level of requirements maturity.

  • Designing pricing and payment mechanisms that encourage collaboration, incremental value delivery, transparency, quality, and sustainable supplier performance.

  • Understanding commercial trade-offs associated with flexibility, cost certainty, scope certainty, supplier risk, customer risk, incentives, and contractual change mechanisms.
